G8: Ernstige inbreuk op de persvrijheid - mobiel redactiebureau door politie in beslag genomen

Bad Doberan, 6 juni 2007, tegen 19.30 uur. In de August-Bebel-Straße, direct naast het infopunt van de G8-tegenstanders aan het Kamp in Bad Doberan, omsingelt een grote groep politieagenten in strijduitrusting de 'Amsterdamse Mediabus' van het initiatief Dissent-Nederland.

De bus dient zo'n twintig onafhankelijke journalisten en mediaactivisten uit heel Europa en de VS als servicepunt en mobiel redactiebureau, en als bewaarplaats van hun foto- en video-apparatuur. De meeste journalisten bevinden zich op dat moment bij de grote zitblokkade op de toegangsweg naar de veiligheidszone van de G8-top. Zeven laptops staan gedeeltelijk in de pauzestand op de werktafels in de bus - via W-LAN beschikt de bus over een internetverbinding voor het publiceren van artikels en foto's.

Onder het roepen van leuzen als "This is What Democracy Looks Like" proberen dertig activisten van een sambaband de aandacht te vestigen op de gebeurtenissen bij de bus. Met enige drang worden ze door de behelmde agenten weggeduwd, terwijl de bus door zes agenten doorzocht wordt en een daarin aanwezige journalist (Hans C. van het Centre des Medias Alternatives de Bruxelles, www.CeMAB.be) gearresteerd wordt: "Ik had de indruk dat de agenten zeer nerveus waren, Ik was bang bij de kleinste beweging in elkaar geslagen te worden," aldus Hans C.

Uiteindelijk werd de Nederlandse chauffeur van de mediabus door de politie gedwongen om de bus naar Rostock naar het politiecompleks bij de 'gevangenenverzamelplek' Industriestraße te rijden. Ze zouden op zoek zijn naar een piratenradio en het vermoeden hebben dat de zender zich in de bus zou bevinden, aldus de verklaring van de politiechef voor de actie. Bovendien zouden ze de Nederlandse APK-keuring niet erkennen, en daarom moest de bus in beslag genomen worden. Later werd een te hulp geschoten advokaat verteld dat vanuit het mobiele bureau het 'Zwarte Blok' gecoordineerd zou zijn. Deze veronderstellingen van de politie zijn allen onwaar.

Volgens informatie van de "Stadtanzeiger am Samstag" uit Bad Doberan (07.06.07) was de persafdeling van de speciale politiedienst voor de G8-top "BAO Kavala" na navraag door het blad niet in staat om welk voorval dan ook op het genoemde tijdstip in de binnenstad van Bad Doberan "te onderzoeken". De chauffeur en de gearresteerde journalist werden gedurende de nacht vastgehouden en in de ochtend van 07.06.07 vrijgelaten. Na tussenkomst van de journalistenbonden NVJ (Nederland) en DJV (Duitsland) werd de mediabus in de loop van de middag van 07.06.07 weer vrijgegeven. De organisatoren van de bus zullen met hulp van de NVJ een zaak tegen de Bondsrepubliek Duitsland aanspannen om schadevergoeding te eisen. Ook Hans C. overweegt een proces aan te spannen.

Al op 05.06.07 was de bus op weg naar een aangemelde protestbijeenkomst van G8-kritici bij het militaire vliegveld Laage illegaal en zonder getuigen doorzocht. Een behelmde groep van honderd ('Hundertschaft') politieagenten uit Göppingen stopte het mobiele redactiebureau tegen 16.45 uur op een parkeerterrein bij Ziesendorf vlabij Schwaan en omsingelde het voertuig. De journalisten moesten een voor een uitstappen en hun bagage en schoenen laten doorzoeken. De personalia werden opgeslagen. Om zich te beschermen tegen geweld namen de journalisten de voorvallen uitvoerig op met hun uiteenlopende opname-apparaten. Het maken van beelden van buitenaf de politie-omsingeling, die tot 17.40 uur duurde, werd echter niet toegestaan. De operatie geschiedde volgens de politie onder leiding van PHK (Polizeihauptkommissar) Hensel en POK (Polizeioberkommissar) Schobel. De persdienst van BAO Kavala kon betreffende de gebeurtenis in Ziesendorf telefonisch slechts meedelen dat men als betroffene per email een bezwaar in kon sturen. Een perswoordvoerder van de politie op de plek van de manifestatie in Laage noemde het voorval later "heel normaal" - tenslotte waren de grondrechten en ook de persvrijheid in het kader van de uitzonderingstoestand "een beetje ingeperkt".

G8: Schwerer Eingriff in die Pressefreiheit - mobiles Redaktionsbüro von Polizei beschlagnahmt.

Bad Doberan, 6. Juni 2007, gegen 19.30 Uhr. In der August-Bebel-Straße, gleich neben dem Info-Punkt der G8-Gegner am Bad Doberaner Kamp, umstellt ein Großaufgebot an Polizeikräften in Kampfmontur den "Amsterdamer Medienbus" der Initiative Dissent Niederlande.

Der Bus dient etwa 20 freien Journalisten und Medienaktivisten aus ganz Europa und den USA als Servicepunkt und mobiles Redaktionsbüro sowie
als Depot für ihre Foto- und Videoausrüstungen. Die meisten der Journalisten befinden sich zu diesem Zeitpunkt bei der großen Sitzblockade auf dem Zufahrtsweg zur Sicherheitszone des G8-Gipfels. 7 Laptops stehen teils im Ruhemodus auf den Arbeitstischen - über W-LAN verfügt der Bus über eine Internetverbindung zum Publizieren von Artikeln und Fotos.

Mit Rufen wie "this is what democracy looks like!" machen 30 Aktivisten einer Sambaband auf die Vorgänge am Bus aufmerksam. Mit einigem Gerangel werden sie von den behelmten Beamten abgedrängt, während der Bus von 6 Polizisten durchsucht wird und ein darin anwesender Journalist (Hans C. vom Centre des Medias Alternatives de Bruxelles, www.CeMAB.be) festgenommen wird. "Ich hatte den Eindruck, daß die Beamten sehr angespannt waren. Ich hatte Angst, bei der kleinsten Bewegung verprügelt zu werden", so Hans C.

Schließlich wird der Niederländische Fahrer des Medienbusses von der Polizei gezwungen, den Bus nach Rostock auf das Polizeigelände bei der Gefangenensammelstelle Industriestraße zu fahren. Man sei auf der Suche nach einem Piratenradio und vermute den Sender im Bus, so die Begründung des Polizeiführers für die Aktion. Außerdem wolle man den niederländischen TÜV nicht anerkennen, deshalb werde der Bus beschlagnahmt. Später heißt es einem hinzugezogenen Rechtsanwalt gegenüber, von dem Mobilen Büro aus wäre der "Schwarze Block" koordiniert worden. Alle diese Behauptungen der Polizei sind unwahr.

Nach Informationen des "Stadtanzeiger am Samstag" aus Bad Doberan (07.06.07) sei die Polizei-Pressestelle der "BAO Kavala" auf Anfrage des Blattes nicht in der Lage gewesen, überhaupt einen Vorfall in der Bad Doberaner Innenstadt für die genannte Uhrzeit zu "recherchieren". Der Fahrer und der festgenommene Journalist werden über Nacht in Polizeigewahrsam gehalten und am Morgen des 07.06.07 freigelassen. Nach Intervention der Journalistenverbände NJV (Niederlande ) und DJV (Deutschland) wird der Medienbus am Nachmittag des 07.06.07 wieder freigegeben. Der NJV wird die Bundesrepublik Deutschland nun auf Schadenersatz verklagen. Auch Hans C. erwägt, zu klagen.

Bereits am 05.06.07 war der Bus auf dem Weg zur angemeldeten Protestkundgebung der G8-Kritiker am Militärflughafen Laage illegal und ohne Zeugen durchsucht worden. Eine behelmte Hundertschaft Polizei aus Göppingen stoppte das mobile Redaktionsbüro gegen 16.45 Uhr auf einem Parkplatz bei Ziesendorf nahe Schwaan und umstellte das Fahrzeug. Die Journalisten mußten einzeln aussteigen und ihr gesamtes Gepäck sowie ihre Schuhe durchsuchen lassen. Die Personalien wurden Festgestellt. Zum Schutz vor Übergriffen dokumentierten die Journalisten die Situation ausführlich mit ihren jeweiligen Aufnahmegeräten. Das Anfertigen von Bildern von außerhalb der bis 17.40 Uhr andauernden "Umschließung" durch die Polizei (Einkesselung) wurden jedoch nicht gestattet. Die Maßnahme wurde laut Polizei angeordnet von PHK Hensel und POK Schobel; nährere Auskünfte würde nur die Kavala erteilen.

Die Pressestelle der BAO Kavala konnte zum Vorfall in Ziesendorf telefonisch lediglich mitteilen, dass man als Betroffener ja per Email eine Beschwerde senden könne. Ein Pressesprecher der Polizei am Kundgebungsort in Laage bezeichnete das Vorgehen später als "ganz Normal" - schließlich wären die Grundrechte und auch die Pressefreiheit in Anbetracht der Ausnahmesituation "ein wenig eingeschränkt".

G8: Severe infringement of press freedom - mobile media bus confiscated by police

On 6 June 2007 at 7.30 pm, around 100 German riot police encircles the 'Amsterdam Media Bus', organised by the network Dissent from the Netherlands. At the time, the Media Bus is standing in the August-Bebel-Straße in Bad Doberan, near Heiligendamm, next to the Info-point Bad Doberan, one of several independent information centres set up by activists that provides coffee, food, medical care and up-to-date information about the protests.

The Media Bus provides a free editing space and safe storage for laptops and cameras for freelance journalists and media activists and is used by around 20 journalists from all over Europe and the U.S. At the time of the raid, most of the journalists are at the mass blockades at the main entry roads to the security zone around Heiligendamm. Seven laptops are standing on the tables in the bus, some of them in stand-by mode, as journalists use the space to upload their edited photos and texts onto the internet and private servers through a wireless network connection.

Shortly after the police starts surrounding the bus, around 30 activists from a samba band draw attention to what is happening by shouting "this is what democracy looks like". After some scuffling with police they are kept at bay whilst around six riot police search the bus and detain a journalist inside the bus as well as the bus driver. Hans C. from the Centre des Medias Alternatives de Bruxelles (www.CeMAB.be) later says "I had the impression that the police officers were very tense. I was afraid they would beat me if I would show only even slight resistance".

The Dutch driver of the Media Bus is forced by the police to drive the bus onto the terrain of the specially built 'prisoner collection point' (Gefangenensammelstelle) in the Industriestraße in Rostock, several kilometres away. Meanwhile, the officer in command announces the reason for the action: police suspect the bus to host an illegal radio station. Further, the German authorities do not accept the Dutch safety certification (APK) of the bus (TÜV in Germany, MOT in the UK), which is also the official reason given for its confiscation. Even later, police tell the lawyer who is called by the Media Bus team that the bus is suspected of functioning as a coordination point for the "Black Block". All of these accusations by the police are untrue and have no foundation in reality.

According to the local newspaper from Bad Doberan "Stadtanzeiger am Samstag" (7.6.2007), when questioned as to the incident, the press office of the police unit "BAO Kavala" (BAO: Besondere Aufbauorganisation), especially created in 2005 to coordinate the policing of the summit, apparently did not know of the action and replied cryptically that it was not able to "research" any event that took place in Bad Doberan on the given time span. The driver and journalist were detained by the police overnight and released the next morning (7.6.2007) without charge. After interventions by the main journalist trade unions from the Netherlands (NVJ) and Germany (DJV), the Media Bus was released in the afternoon of 7.6.2007. The NJV is now planning to take the German state to court to claim damages. The journalist Hans C. is also considering taking the German state to court.

This incident was not the first infringement of independent media work in Heiligendamm. The Media Bus was unlawfully stopped and searched already on 5.6.2007, without any witnesses present, on its way to the protest rallies that took place near the military airport Rostock-Laage. At 4.45 pm, around 100 riot police from Göppingen stopped and encircled the bus at a parking lot near Ziesendorf nearby the village of Schwaan. The journalists had to leave the bus one by one and they and their luggage were searched, they even had to take off their shoes. All identities were registered. To protect themselves from possible police violence, the journalists were filming the action, however, the police did not allow any filming or photos to be made form outside of the police encirclement, which lasted until 5.40 pm. When asked about the reasons for the police search, the police said the action was ordered by police inspectors Hensel (Polizeihauptkommissar) and Schobel (Polizeioberkommissar) and that any further information would only be provided by the police coordination unit BAO Kavala.

BAO Kavala commented on the police action of 5.6.2007 with the dismissive remark that those affected could complain about the infringement via e-mail. A police spokesman present at the rally in Rostock-Laage commented that the police actions had been "normal procedure", because in the face of the emergency situation fundamental rights, including freedom of press, were "slightly restricted".
